Oregon’s Equal Rights for All Campaign, Partner Organizations Respond to US v Skrmetti Supreme Court Decision

This morning, the US Supreme Court released its decision in US v Skrmetti, ruling that Tennessee’s gender-affirming care ban for minors does not discriminate against transgender youth based on their sex and is constitutional. The Equal Rights for All Campaign (ERA Campaign) and coalition partners Basic Rights Oregon (BRO), ACLU of Oregon, and Latino Network recognize this is a painful time for transgender youth, their families, and all transgender people. Our campaign and organizations will continue fighting for everyone’s right to be who we are and make private medical decisions with doctors, not politicians.

“This is a devastating outcome for transgender people, our families, and our medical providers,” said Blair Stevick (they/he), spokesperson for the ERA Campaign and Basic Rights Oregon. “ But no matter what the Court ruling says, transgender people and their families are not alone in this struggle. The Equal Rights for All Campaign isn’t done fighting—we’re just getting started.”

“We still have powerful tools to fight back against the Trump administration’s attacks on transgender people at the state and federal level,” said Eri Andriola (they/them), litigation manager at ACLU of Oregon.  “Gender affirming care is still legal in Oregon, and Oregon law prohibits discrimination against people based on their gender identity or sex, including from healthcare providers. And with the Equal Rights for All Campaign, we have the opportunity to galvanize our community to explicitly affirm in our state constitution that every single Oregonian has the right to make our own decisions about our health and our bodies, without interference from politicians.”

“We have tools to fight back at the federal level too. There is still a strong body of legal precedent showing that policies that discriminate against people based on their identities do indeed violate the Equal Protection Clause. We will continue to defend and advance the rights of trans people in all areas of life.”

Equal Rights for All is a 2026 Oregon ballot measure campaign that will guarantee equal rights regardless of one’s sex, gender identity, or sexual orientation. It will affirm the right to abortion, contraception and IVF, transgender health care, and same-gender marriage in the Oregon Constitution. Now more than ever, it’s crucial for Oregonians to do everything we can to secure our equal rights and freedom.

The ERA Campaign will host a Week of Resilience next week, providing space for our community to grieve this loss and prepare for the work ahead of us. We will also host a Trans Power Rally the evening of July 2. Find more information here.
